Welcome to RPF STOMP, by R Personal Fitness. These Terms of Service (“Terms”) govern your access to and use of [Website URL], our mobile applications, registration services, communications, and related services (collectively, the “Services”).

By using the Services, you agree to these Terms. If you are registering or using the Services on behalf of a child or other minor, you represent that you are the child’s parent or legal guardian, or that you have appropriate authority to act on the child’s behalf.

1. Youth Participants and Parent/Guardian Responsibility

Our Services may be used by children and teenagers participating in youth sports programs.

A parent or legal guardian is responsible for:

  • reviewing these Terms and our Privacy Policy before registering a minor;

  • providing accurate information about the participant;

  • obtaining any permissions required for the participant's participation;

  • supervising the minor's use of the Services as appropriate for the minor's age; and

  • ensuring that the minor follows applicable team, league, facility, and program rules.

Where parental or guardian consent is required by applicable law, we will obtain consent using a method reasonably appropriate to the circumstances.

Participants under the age of 18 may not enter into agreements requiring legal capacity on their own where applicable law requires a parent or guardian to do so. A parent or legal guardian may accept these Terms on behalf of a minor participant where appropriate.

2. Eligibility and Accurate Information

You agree to provide truthful, current, and complete information when creating an account or registering a participant.

Information may include a participant's name, age, date of birth, team, school, emergency contact information, parent or guardian information, and other information reasonably necessary to administer a sports program.

You must promptly update information that becomes inaccurate or changes.

We may refuse or cancel a registration when information is inaccurate, eligibility requirements are not satisfied, required consent has not been obtained, or participation would violate applicable league, facility, or program rules.

3. Sports Participation and Safety

Youth sports involve inherent risks, including the risk of physical injury.

Participation in any athletic activity is voluntary. Parents and guardians are responsible for determining whether a participant is physically and otherwise appropriately prepared to participate, subject to applicable law and the requirements of the particular program.

Our website and registration services do not provide medical advice. Information on the Services should not be treated as a substitute for advice from a qualified healthcare professional.

If a participant has a medical condition, allergy, medication requirement, or other health or safety concern relevant to participation, parents or guardians should provide appropriate information through the designated registration or emergency-contact process.

4. Program Rules

Participation in a particular team, league, tournament, camp, clinic, practice, or event may be subject to additional rules.

Those rules may address:

  • eligibility and age divisions;

  • attendance and participation;

  • uniforms and equipment;

  • conduct;

  • sportsmanship;

  • transportation;

  • facility rules;

  • disciplinary procedures;

  • weather-related decisions;

  • cancellations and postponements; and

  • requirements imposed by governing athletic organizations.

If a program-specific rule conflicts with these Terms, the program-specific rule will control with respect to that program, unless prohibited by applicable law.

5. Prohibited Conduct

Users may not use the Services to:

  • harass, threaten, bully, intimidate, or abuse another person;

  • discriminate against another person;

  • engage in sexual or exploitative conduct involving a minor;

  • impersonate another person;

  • submit false or misleading information;

  • interfere with another person's use of the Services;

  • attempt to gain unauthorized access to accounts or systems;

  • upload malicious software or harmful code;

  • collect personal information about children or other users without authorization;

  • use the Services for unlawful purposes; or

  • violate any applicable law, league rule, facility rule, or program policy.

We may suspend or terminate access to the Services or take other appropriate action when we reasonably believe these rules have been violated.

6. Accounts and Account Security

If the Services allow users to create accounts, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account, except to the extent that applicable law provides otherwise.

Parents and guardians should not permit children to use an adult account in a manner that misrepresents the child's identity or age.

You must notify us promptly if you believe an account has been accessed without authorization.

7. Registration, Fees, and Payments

Registration fees, membership fees, event fees, equipment fees, and other charges will be disclosed during the applicable registration process.

By submitting a registration or payment, you authorize [Organization Name] or its payment processor to charge the payment method provided for the amounts disclosed at registration.

Unless otherwise stated in the applicable program's refund policy, fees are subject to the cancellation and refund terms presented during registration.

We may use third-party payment processors. Payment information may be collected and processed by those providers in accordance with their applicable terms and privacy practices.

8. Cancellations, Postponements, and Refunds

Programs, practices, games, tournaments, camps, and other activities may be canceled, postponed, relocated, or modified because of weather, facility availability, scheduling issues, safety concerns, insufficient enrollment, emergencies, or other circumstances.

Any applicable refund, credit, or cancellation policy will be provided during registration or in the applicable program materials.

Nothing in these Terms limits any refund or consumer rights that cannot lawfully be waived under New York or federal law.

9. Photos, Video, and Publicity

We may photograph or record participants during games, practices, tournaments, camps, or other organizational activities.

Any use of a minor's name, image, likeness, photograph, video, or other identifying information for promotional, advertising, social-media, or similar purposes will be handled in accordance with applicable law and any permissions or releases we obtain.

Where consent is required, we will not rely on these Terms alone as a substitute for any legally required consent or release.

Parents or guardians may contact us at regis@rpersonalfitness.life regarding questions or requests concerning photographs or recordings of their child.

10. User Content and Communications

If the Services allow users to submit comments, photographs, videos, messages, reviews, or other material (“User Content”), you are responsible for the content you submit.

You may not submit User Content that:

  • identifies or exposes a child to unnecessary privacy or safety risks;

  • contains unlawful, threatening, abusive, defamatory, or sexually explicit material;

  • infringes another person's intellectual-property or privacy rights;

  • contains another person's personal information without appropriate authorization; or

  • violates these Terms or applicable law.

We may remove or restrict User Content that we reasonably believe violates these Terms or creates a safety, privacy, or legal concern.

Because our Services involve minors, we may apply stricter moderation and safety standards to User Content and communications involving children.

11. Child and Minor Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

Because our Services may involve minors, additional privacy protections may apply under federal and New York law. Depending on the nature of the Services and the information collected, these requirements may include the federal Children's Online Privacy Protection Act (“COPPA”) and New York's Child Data Protection Act.

We will process personal information in accordance with applicable law and our Privacy Policy.

We will not use these Terms to obtain consent that is legally required to be obtained through a separate parental-consent, privacy, or authorization process.

12. Third-Party Services

The Services may contain links to or integrations with third-party services, including payment processors, registration platforms, scheduling services, athletic organizations, social-media platforms, mapping services, or analytics providers.

Your use of a third-party service may be governed by that provider's separate terms and privacy policy.

13. Intellectual Property

The Services and their contents, including our logos, names, graphics, text, software, designs, photographs, and other materials, are owned by or licensed to RPF STOMP, by R Personal fitness and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not copy, modify, distribute, sell, publicly display, or commercially exploit our materials without our prior written permission.

14. Accessibility

We seek to make the Services accessible to users with disabilities.

15. Suspension and Termination

We may suspend or terminate an account or access to the Services when reasonably necessary to:

  • protect participants or other users;

  • investigate suspected misconduct;

  • discontinue or materially change the Services.

Where appropriate, we will provide notice and an opportunity to address the issue.

Termination does not eliminate obligations that by their nature should continue after termination.

16. Disclaimers

The Services are provided on an “as available” basis.

We do not guarantee that the website or any particular feature will always be available, uninterrupted, secure, or error-free.

Information about schedules, standings, rosters, locations, events, or programs may change and should be confirmed through official program communications when appropriate.

Nothing in these Terms excludes or limits any warranty, right, remedy, or protection that cannot lawfully be excluded or limited under applicable law.

17. Limitation of Liability

To the maximum extent permitted by applicable law, RPF STOMP by R Personal Fitness will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to use of the Services.

Nothing in these Terms is intended to waive or limit liability that cannot legally be waived or limited, including liability that applicable law prohibits us from excluding.

18. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims arising from your material violation of these Terms, your unlawful use of the Services, or your unauthorized submission of another person's information or content.

Nothing in this section requires a parent or minor to indemnify RPF STOMP by R Personal Fitness where such an obligation is prohibited or unenforceable under applicable law.

19. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we will provide notice through the Services or by another reasonable method.

The updated Terms will become effective on the date stated in the updated Terms, subject to any notice or consent requirements imposed by applicable law.

20. Governing Law

These Terms will be governed by the laws of the State of New York, without regard to conflict-of-law principles, except to the extent federal law or another applicable law requires otherwise.

Any dispute-resolution provision, including any arbitration requirement or waiver of a right to participate in a class action, will apply only to the extent permitted by applicable law and should be reviewed by New York counsel before inclusion.

21. No Waiver of Legal Rights

Nothing in these Terms is intended to waive, limit, or diminish any right or protection provided to consumers, parents, guardians, or minors by applicable federal, New York State, or local law.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Parent/Guardian Acknowledgment

When registering a minor participant, the registering parent or legal guardian may be required to confirm:

I represent that I am the parent or legal guardian of the participant, or otherwise have authority to act on the participant's behalf. I have reviewed these Terms of Service and the Privacy Policy and understand that participation in youth sports involves inherent risks. I consent to the participant's registration and use of the Services subject to the applicable program rules and policies.
